These Terms & Conditions apply to HAWK Wellness & Sports Therapy memberships. By purchasing a membership, you confirm that you have read, understood and agreed to these Terms & Conditions.

1. MEMBERSHIP OPTIONS
HAWK currently offers the following 12-month memberships:
HAWK ESSENTIAL — £21 per month
• 6 × 45-minute treatment sessions during the 12-month membership
• One treatment credit released every two months
• Priority booking
• 5% HAWK Recovery product discount
HAWK PERFORMANCE — £39 per month
• 12 × 45-minute treatment sessions during the 12-month membership
• One treatment credit released each month
• Priority booking
• 10% HAWK Recovery product discount
HAWK ELITE — £75 per month
• 24 × 45-minute treatment sessions during the 12-month membership
• Two treatment credits released each month
• Priority booking
• 15% HAWK Recovery product discount

2. 12-MONTH MEMBERSHIP
The monthly membership is a 12-month membership paid in monthly instalments.
It is not a pay-as-you-go arrangement or a membership that ordinarily ends simply because a member stops attending treatments.
The minimum payments over the initial 12-month term are:
Essential: £252
Performance: £468
Elite: £900
Any statutory cancellation rights and the provisions contained within these Terms remain unaffected.

3. MEMBERSHIP START DATE
Your membership begins on the date confirmed when you sign up.
Monthly payments will normally be collected automatically using the payment method registered through our payment provider.
Treatment credits will be released in accordance with your chosen membership.
Payment of a monthly instalment does not release all treatments included within the full 12-month membership.

4. TREATMENT CREDITS
Each membership treatment credit entitles the member to one standard 45-minute eligible treatment appointment.
Credits are released as follows:
Essential: one credit every two months
Performance: one credit each month
Elite: two credits each month
Credits cannot ordinarily be borrowed from future membership periods.
HAWK may, at its discretion, permit an appointment to be brought forward where appropriate. This does not change the member’s payment obligations or create an entitlement to future early release of credits.

5. CREDIT EXPIRY AND ROLLOVER
Unused treatment credits may be carried forward for up to 90 days from the date on which the individual credit was issued.
After 90 days, an unused credit will expire.
Members are responsible for arranging appointments sufficiently early to use their available credits.
If HAWK is unable to provide reasonable appointment availability before a credit expires, HAWK will extend the affected credit for a reasonable period so that the member has a fair opportunity to use it.
Credits will not expire solely because HAWK cancelled an appointment or was unable to provide the booked service.

6. BOOKING APPOINTMENTS
All appointments remain subject to availability.
Priority booking provides membership clients with access to membership booking benefits but does not guarantee a specific appointment time, date, practitioner or location.
Members are encouraged to book in advance, particularly for popular appointment times.

7. WHAT A MEMBERSHIP SESSION INCLUDES
Membership credits are intended for HAWK’s standard eligible 45-minute treatment sessions.
Treatment may include appropriate elements of services such as:
• Sports massage
• Soft tissue treatment
• Mobility work
• Trigger point techniques
• Cupping
• IASTM
• Other appropriate manual therapy techniques
The treatment provided will depend upon clinical assessment, suitability and the member’s needs at the time.
Membership credits do not automatically include separate services such as gait analysis, dedicated rehabilitation appointments, injection therapy, or any other separately priced service unless HAWK expressly agrees otherwise.
HAWK does not guarantee any particular clinical outcome from membership or treatment.

8. CLINICAL SUITABILITY
All treatment remains subject to clinical suitability.
HAWK and its practitioners reserve the right to modify, postpone or decline a particular treatment where they reasonably consider that treatment would be inappropriate or unsafe.
Where appropriate, a member may be advised to seek assessment or treatment from another healthcare professional.
Nothing in the membership guarantees that a particular treatment technique will be provided.

9. CANCELLATION AND RESCHEDULING OF APPOINTMENTS
HAWK’s normal appointment cancellation policy applies to membership appointments.
The applicable cancellation policy will be made available to members when booking.
Where an appointment is cancelled late or the member fails to attend, HAWK may treat the relevant membership credit as used where this is permitted under the applicable cancellation policy.
Nothing in this clause affects circumstances where cancellation is caused by HAWK or where applying the charge would be unlawful or unfair.

10. HAWK CANCELLATIONS
If HAWK needs to cancel an appointment, the treatment credit will remain available to the member.
HAWK will make reasonable efforts to offer an alternative appointment.
A member will not lose a treatment credit because HAWK cancelled the appointment.

11. PAYMENT
Monthly membership payments are collected automatically using the payment method provided when joining.
The member is responsible for maintaining a valid payment method and ensuring sufficient funds are available.
HAWK may use a third-party payment processor to collect membership payments.

12. FAILED OR MISSED PAYMENTS
If a membership payment fails, HAWK may contact the member and/or attempt to collect the outstanding payment again.
While payment remains overdue, HAWK may temporarily suspend:
• Release of new treatment credits
• Use of unused membership credits
• Member discounts
• Other membership benefits
Any suspension will be proportionate to the outstanding payment.
The member will be given a reasonable opportunity to correct the failed payment.
Repeated or unresolved non-payment may result in termination of the membership in accordance with these Terms.
Termination does not remove liability for payments that were already properly due before termination.

13. 14-DAY CANCELLATION RIGHT
Where the membership is purchased online, by telephone, or otherwise at a distance and statutory cancellation rights apply, the member normally has 14 days from entering into the contract to cancel without giving a reason.
To exercise this right, the member should clearly notify HAWK of the decision to cancel using the contact details provided below.
If the member asks HAWK to begin providing services during the 14-day cancellation period and then exercises their statutory cancellation right, HAWK may charge an amount permitted by law for services properly supplied before cancellation.
Any refund due following valid statutory cancellation will be processed in accordance with applicable consumer law.
Nothing in these Terms limits the member’s statutory rights.

14. EARLY CANCELLATION AFTER THE COOLING-OFF PERIOD
The membership is sold as a 12-month commitment.
However, HAWK recognises that circumstances can materially change.
A member wishing to end the membership early should contact HAWK.
HAWK will consider reasonable requests for early termination, including circumstances such as:
• Serious illness or injury preventing continued use
• Pregnancy where continued treatment is unsuitable or impractical
• Permanent relocation making reasonable attendance impractical
• Significant financial hardship
• Other exceptional circumstances
Reasonable supporting evidence may be requested where appropriate.
Any amount charged on early termination will be reasonable and proportionate and will not exceed HAWK’s actual entitlement under applicable consumer law.
HAWK will not impose an excessive penalty solely because a member wishes to cancel.

15. MEMBERSHIP FREEZES
HAWK may agree to temporarily freeze a membership in appropriate circumstances including significant injury, surgery, pregnancy or other exceptional circumstances.
Freezes are considered individually and must be agreed by HAWK.
Where a freeze is agreed, HAWK will confirm in writing:
• The freeze start date
• The expected end date
• Whether payments are paused
• How unused credits will be treated
• Any revised membership end date
A membership is not considered frozen until HAWK confirms the freeze.

16. NON-TRANSFERABLE MEMBERSHIP
Memberships and treatment credits are personal to the registered member.
Unless HAWK expressly agrees otherwise, credits:
• Cannot be transferred to another person
• Cannot be sold
• Cannot be exchanged for cash
• Cannot be used to purchase products
• Cannot be used against another person’s treatment

17. MEMBER PRODUCT DISCOUNTS
Where a membership includes a HAWK Recovery product discount, the discount applies during an active, paid membership.
Discounts:
• Are personal to the member
• Cannot ordinarily be combined with another promotion unless stated otherwise
• Have no cash value
• May exclude selected products or promotions where this is clearly stated before purchase

18. CHANGES TO MEMBERSHIP
HAWK will not materially reduce the core benefits or increase the agreed price during a member’s initial fixed 12-month term without the member’s agreement, except where a change is required by law or is otherwise legally permitted.
Minor administrative or operational changes may be made where they do not materially disadvantage the member.
Where a material change is proposed, members will receive reasonable notice and any rights required by law.

19. MEMBERSHIP RENEWAL
The member will be clearly informed before joining how the membership operates at the end of the initial 12-month term.
HAWK will not rely on hidden or unclear automatic-renewal provisions.
If the membership continues after the initial fixed term, the applicable renewal/cancellation arrangements will be clearly communicated to the member in advance and will comply with applicable consumer law.

20. TERMINATION BY HAWK
HAWK may terminate or suspend a membership where there is a reasonable and proportionate basis to do so, including:
• Persistent non-payment
• Fraudulent use of membership benefits
• Threatening, abusive or inappropriate behaviour towards staff or other clients
• Serious or repeated breach of these Terms
Where reasonably possible, HAWK will give the member an opportunity to remedy a breach before termination.
Any financial consequences of termination will be handled fairly and in accordance with applicable consumer law.

21. CLOSURE OR INABILITY TO PROVIDE SERVICES
If HAWK permanently stops providing the membership service or becomes unable to provide outstanding prepaid services, members will be entitled to an appropriate remedy in accordance with applicable consumer law.
This may include a refund for prepaid services that HAWK cannot provide.

22. LIABILITY AND STATUTORY RIGHTS
Nothing in these Terms excludes or restricts liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
Nothing in these Terms affects the member’s statutory consumer rights.

23. PERSONAL INFORMATION
Personal information will be processed in accordance with HAWK’s applicable privacy policy and data-protection obligations.
Payment information may also be processed by HAWK’s third-party payment provider in accordance with that provider’s privacy terms.

24. COMMUNICATION
Members are responsible for keeping their contact details up to date.
Important membership communications may be sent using the email address or other contact information supplied by the member.

25. COMPLAINTS
If you have a concern regarding your membership, payment or treatment, please contact HAWK in the first instance so that we can investigate and try to resolve the matter.

26. GOVERNING LAW
These Terms are governed by the applicable law of England and Wales.
Nothing in this clause deprives a consumer of any mandatory legal protections or rights available to them.

27. ACCEPTANCE
By purchasing a HAWK Membership, the member confirms that they have been given the opportunity to read these Terms & Conditions before entering into the membership.
The member acknowledges the membership selected, price, payment frequency, initial membership period and treatment-credit structure.
By joining, you agree to these Terms & Conditions and acknowledge that your membership is a 12-month commitment, subject always to your statutory rights.
